General conditions


These General Conditions are expressly accepted by the contracting party and complement the catalog, which can be accessed through the website and the emails or communications exchanged between the parties for the contracting. In case of contradiction, these General Conditions prevail, except that: 

  • Changes in said information have been communicated in writing to the consumer before the date of conclusion of the contract, and this possibility has been expressly mentioned in the brochure and website.
  • That there are subsequent modifications expressly agreed and in writing, between the contracting parties.
  • That there is a case of force majeure.

1. General Data

2. Legal regulation applicable to the contract and acceptance of the general conditions

These General Conditions are subject to what results from the application of RDL 1/2007 of November 16, which approves the revised text of the General Law for the Defense of Consumers and Users, Law 7/1998, of November 13 April, on the General Contracting Conditions, and the Civil Code. These General Conditions will be incorporated, signed by the contracting parties, into all contracts of Red Leaf SL Programs whose object is the Programs contained in the advertising brochure and website and oblige the parties, together with the particular conditions that are agreed in the contract, and those that could be established for each program.

3. Registration, price, and payment method

  1. Any application for enrollment in any of our Programs must be made through the website www.redleaf.es and accompanied by the payment of the following amounts as a reservation:
    • A. € 1,000 for CAMPS IN CANADA AND LEADERSHIP Programs.
    • B. € 1,250 for INTEGRATION Programs
    • C. € 1,500 for ACADEMIC YEAR programs.
    • D. € 1,000 for SUMMER Programs IN CANADA AND ADULTS.
  2. The payment of these amounts is considered to be made as payment on account of the price of the service and must be made through the payment platform in the on-line registry, by bank transfer or in cash. This amount, delivered on account, will be deducted from the total price of the Program.
  3. No application for enrollment in a Program will be processed that is not accompanied by proof of having made the payment of the reservation corresponding to each program.
  4. The rest of the price of the contracted Program, in the part that is paid in Spain, must be paid to Red Leaf SL eight weeks before the start of the program (student departure), except for the INTEGRATION and ACADEMIC YEAR programs, which must be paid ten weeks before the start of the program.
  5. The amounts, if any, to be paid locally to the school districts in CANADA, the payment of which is made directly by the client to said organizations and in Canadian dollars, will be paid within the terms indicated by said organizations.
  6. Discounts or promotions will never be cumulative with other discounts and promotions.
  7. Places are limited. It is recommended to enroll in the INTEGRATION and ACADEMIC YEAR Programs with a minimum of 90 days and in the other Programs with a minimum of 60 days, prior to the expected date of departure.
  8. Additional forms required by the Canadian Supplier must be completed and signed by the contracting party.

Registrations are personal and non-transferable. The place will be considered reserved only when Red Leaf SL confirms this circumstance in writing. You must personally deliver, send by mail or online the registration application of Red Leaf SL completed, signed and accompanied by the documentation requested by each School District or Private School that will include these conditions, duly signed.

Exclusively for the ACADEMIC YEAR program, the candidate will be selected through a personal interview, to which he will be summoned at the convenience of both parties. This interview will be conducted in English and Spanish. Also, the student could take a written test in English. The price of the courses is what appears, for each program, on the website. All prices are inclusive of legally applicable taxes. Red Leaf SL reserves the right to cancel the participation in the program of those participants who do not comply with the promised payments.

In the case of ACADEMIC YEAR Programs, the contractor will pay the corresponding amount of the Program directly into the Canadian School District account, in the official currency of the destination country, paying for all expenses and transfers related to banking services. The amount of the ACADEMIC YEAR program must be paid as specified in the payment conditions of the School District. Without said payment, no official document of acceptance in the program of an official nature and of an essential nature for obtaining the visa will be provided.

4. Price review

The final prices of the Programs are subject to possible variations, both up and down, as a result of possible changes in prices or local (Canadian) rates, such as transport rates, fuel costs, euro / euro exchange rate. Canadian dollar and applicable rates and taxes according to the general conditions of the brochure and website for the current year. The difference, both up and down, will be passed on to the customer at the time of delivery of the final invoice before departure. Variations in prices will be notified to the consumer in writing, and the consumer may, when the variation exceeds 10% of the total price of the program, withdraw from the course, or accept the modification of the contract.

5. Transportation and accommodation

The description of the type of transport and accommodation included in the different courses is detailed in the pages of the brochures corresponding to each destination and course. In certain Summer, High School and Academic Year programs in Canada, the participant will stay with a family that provides accommodation and full board.

When the student travels only for all or part of the journey, they will be given the options and precise instructions so that they can make the trip in conditions of maximum safety and comfort. Red Leaf SL will not be responsible for delays, alterations, accidents or loss of luggage.

In those programs in which the accompaniment service is included, in accordance with what is published in the electronic brochure and the website, Red Leaf SL offers accompaniment on trips as long as the traveling group consists of at least 15 students. If this number is not reached, Red Leaf SL will notify the consumer in advance and offer the necessary alternatives so that they can travel accompanied, in case of being a minor. These alternatives contemplate changing the program under the conditions stipulated in point 7 section a) of the general conditions of the program, the value of which will be passed on directly to the client as an additional cost to the program.

6. Cancellation, no-show and / or abandonment of the program by the consumer

The client may terminate this contract through the electronic means that Red Leaf SL will provide for this purpose with the consequences provided in these general conditions.

However, the right of withdrawal indicated below, in case the participant decides to cancel the contracted program, he must notify Red Leaf SL in writing in any way that is reliable in Law.

In the event of cancellation, Red Leaf SL will have the right to retain:

  • A. € 1,000 for CAMPS IN CANADA AND LEADERSHIP Programs.
  • B. € 1,250 for INTEGRATION Programs.
  • C. € 1,500 for ACADEMIC YEAR programs.
  • D. € 1,000 for SUMMER Programs IN CANADA AND ADULTS.

If the cancellation occurs during the 3 months before the start of the program, in addition to the reservation, you must pay the non-recoverable expenses, the amount of which Red Leaf SL must justify.

If the consumer cancels or abandons the program once in the destination country due to causes attributable to it (of his own free will, or of his parents or legal guardians or is subject to expulsion from the program), the cancellation costs amount to 100% of the total amount of the course.

Red Leaf SL offers an optional cancellation insurance which covers all cancellation costs included in the policy. The price of insurance varies depending on the price of the program in which you participate and must be contracted at the time of the reservation formalization date.

Nor will there be an obligation on the part of Red Leaf SL to indemnify consumers in the event that the cancellation of the program occurs due to not reaching the minimum number of people required (a minimum of 10 participants for summer and integration programs) for the effective realization of it. In these cases, Red Leaf SL will notify the consumer in writing, with a minimum of fifteen days in advance of the start date of the program, that the minimum number of participants has not been reached and that, therefore, the program has been canceled. . In this case of cancellation of the program due to not reaching the minimum number of participants, the consumer will have the right to reimbursement of all the amounts that he had paid for the program without any penalty.

Differences and / or claims that, in the opinion of consumers, arise during the development of the contracted Program, must be brought to the attention of the Organization responsible for the program in the destination country, in order to offer a satisfactory solution immediately. .

7. Alterations and incidents of the program. Program cancellations

The schedule of excursions and activities may suffer variations derived from organizational causes or force majeure. However, Red Leaf SL will always maintain the total number of activities and excursions included in the program and with similar characteristics.

Red Leaf SL undertakes to provide consumers with all the contracted services contained in the Program, with the stipulated conditions and characteristics. However, the following considerations should be taken into account:

If the solution proposed by RED LEAF SL is not satisfactory either, the consumer may initiate the corresponding actions.

8. Uses and customs of the countries where the programs are developed, and mandatory standards during their development.

The consumer must adapt to the way of life and customs of the country in which the contracted Program is developed. The rules of conduct in the destination countries, the customs, the meals, the hours, the distances and, in general, the lifestyle of the countries where the various Programs are developed are usually very different from the way of life and common customs in Spain. In this sense, the consumer must adapt to them and take into account that the host family can be single parent or single parent. The consumer agrees to respect the laws of the country of destination in which the Program is developed, as well as the Discipline Rules of the various Organizations, Colleges, Centers, Universities, Schools, etc., that collaborate with Red Leaf SL in carrying out of the Program. In particular,

In case of non-compliance by the consumer with the laws of the destination country in which the Program is developed, or non-compliance with the Discipline Rules of the various Organizations, Colleges, Centers, Universities, Schools, etc., or possession or consumption of tobacco, alcohol, drugs, etc. the consumer will be expelled from the program. 9. Passports, Visas and Documentation

All consumers who contract the Programs must carry their personal documentation (individual passport and DNI, visas, ESTA for Programs in the USA and eTA for Programs in Canada), in accordance with the regulations of the country where the program is developed. Contracted program. Obtaining visas, when the legislation of the country where the Program is developed so requires, must be done by the consumer. For students who have contracted an ACADEMIC YEAR Program in Canada, the parents, guardians and / or legal representatives will be responsible for the procedures and costs of the “Study Permit” Student Permit and biometric data.

In application of the provisions of “Instruction number 10/2019 of the Secretary of State, which regulates the procedure for granting a travel permit outside the national territory for minors”, minors under the age of 18 who travel outside the national territory and They are not accompanied by their legal representatives (parents and / or guardians), in addition to the DNI or Passport, they will require a signed declaration of travel permission for minors or persons with judicially modified capacity. Said declaration must be processed by the legal representatives (parents and / or guardians) of the minor before one of the following official bodies: National Police, Civil Guard, City Council, judge or notary.

In case of being rejected by any Authority the granting of visas, for particular reasons of the consumer, or being denied entry into the country for lacking the requirements that are required, or by default in the referred documentation, or for not being a bearer of the same, the consumer will assume any expense that arises, applying in these circumstances the conditions and rules established for the cases of voluntary cancellation of services.

10. Insurance

The price of the Program includes the coverage of medical and civil liability insurance, according to the conditions of the multi-assistance insurance policy signed by Red Leaf SL with an international insurance company of recognized prestige. The insurance conditions are included on the website.

11. Medical, pharmacological and / or surgical treatment

The participant must inform Red Leaf SL if they are undergoing any medical and / or pharmacological treatment during their stay in the destination country and throughout the duration of the program.

It is understood that, at the time of starting the program, the participant is in perfect physical and mental health and that the medical information that accompanies the program dossier is true and complete. Otherwise, the company Red Leaf SL is exempt from any type of responsibility derived from the falsity of this information.

Likewise, in the event that, during the development of the program, the consumer needs medical treatment, and / or be hospitalized and / or operated on without Red Leaf SL being able to locate their parents, guardians or legal representatives, Red Leaf SL is authorized to take the measures it deems most appropriate for the health of the consumer.

12. Technical organization of trips

The technical organization of the trips to the destinations in which the different Programs that include the flight are developed, is carried out by a travel agency with authorized CICMA 3790. Red Leaf SL acts solely as an intermediary between the consumer and the Travel Agency. For this reason the company Red Leaf SL is exempt from any type of responsibility derived from cancellations, time or route changes, delays, accidents, lost luggage, etc.

The trip will be paid for by the participant in those programs where the flights are not included in the total price of the aforementioned program.

13. Data transfer authorization

In view of the fact that it is essential and necessary to communicate certain data relating to the participant, which must be known by the companies or entities collaborating with Red Leaf SL, in the destination city, the participant expressly authorizes the corresponding personal data to be transferred.

14. Protection of personal data

In accordance with article 13 of Regulation (EU) 2016/679 of the European Parliament and of the Council, of April 27, 2016, regarding the protection of natural persons with regard to the processing of personal data and the free movement of these data and by which Directive 95/46 / CE (hereinafter, the "RGPD"), and remnants of applicable regulations, Red Leaf SL, as responsible for the treatment, provides as Annex I to the general contracting conditions the basic information on the processing of personal data carried out by the company and collects the necessary consents.

15. Validity

The validity of these general conditions is indefinite. Red Leaf SL reserves the right to make changes, which will come into effect for the contracts entered into after said modification.

16. Integrity of the contract

In the event that any clause of these conditions is declared void, the other clauses will remain in force and will be interpreted taking into account the will of the parties and the very purpose of these conditions, Red Leaf SL may not exercise any of the rights and Powers conferred in this document which will not imply in any case the waiver of them, unless expressly acknowledged by Red Leaf SL

17. Conflict resolution

Any conflict related to the programs will be resolved by the competent Jurisdictional Bodies, according to the applicable legislation. Red Leaf SL is not attached to any arbitration system of the Consumer Boards.

18.Withdrawal

The consumer may withdraw from the contract within fourteen (14) calendar days from its formalization. To do this, you must notify Red Leaf SL in writing within that period, and you will have the right to a refund of all amounts that you have paid for the Program, including the payment made to reserve a place.

19. Contact information in case of emergency

20. Acceptance of these conditions

The option by consumers to operate their Programs through Red Leaf SL implies acceptance by them of all the Conditions contained herein, as well as those that govern each of the destinations operated through our Organization.

21. Billing

The Client has the right to receive the invoice for the services contracted from Red Leaf SL in paper format unless he accepts through the Red Leaf SL web portal the sending of the invoices electronically. However, the foregoing, at any time the client may request the invoice in paper format to Red Leaf SL
